City of Sofia in civic power-sharing deal with developers

In a trade-off for withdrawing their lawsuit against the increase in the price of building permits in Sofia, developers will be allowed to have a say on key civic issues like where and in what to invest, waste management and even municipal budget policy-making.

The municipality is making this concession as part of an out-of-court settlement with the Bulgarian Entrepreneurial Chamber and the National Association of Home Builders which were suing the city for raising last year the cost of building permits close to 20 times to 12 levs/sq m.

In May 2007, the Sofia city court ruled in favor of the developers. The municipality vowed to appeal but as of yesterday the case had not yet reached the Supreme Administrative Court.

The settlement makes pointless any further judicial review but it remains unclear who backed out, the developers or the municipality.

Despite the ongoing litigation, the municipal council had approved a further 50% increase in the price of building permits for 2008. Agreeing to the settlement, the developers also consent to the new tariff in exchange for participation in decisions on the municipal spending allocations.

It's a win-win for the developers because they were already calculating the cost of building permits into the price of their properties but now they will be able to resolve faster the problem with the lack of road infrastructure in newly built districts.

The municipality and the two industry associations will set up a joint committee chaired by Sofia chief architect Petar Dikov.

The committee will tackle construction, investment, budgetary, waste management and other issues.

According to Nikolai Gavrailov, chairman of the entrepreneurial chamber, the committee will have mandate to decide which streets will be renovated, where to build new roads and water and electric grids.
